WKR 2026 for Temp Agencies: Who Pays What?

The WKR rules for recruitment agencies are a bit more complex than for ordinary employers, because you deal with two types of recipients: your own staff and your flex workers (temporary workers). Below are the rules for 2026.

Your own staff (recruiters, account managers, back office)

Gifts for your own employees simply fall under the WKR free space: 2% on the first €400,000 of payroll, and 1.18% above that in 2026. An agency with 30 own employees and an average salary of €45,000 has a payroll of €1.35 million. The free space is then €8,000 + (€950,000 × 1.18%) = about €19,210. Plenty for Christmas, birthdays and a summer gift.

Temporary workers (flex workers through your agency)

This is where it gets more specific. As a temp agency, you are the legal employer of the temporary worker — not the client. That means you as the temp agency can use the WKR free space for gifts to your temporary workers, provided you withhold payroll taxes. In practice: a Christmas gift of €25 for temporary workers can be designated as an end-taxed benefit and included in your free space.

Example calculation — Temp agency with 30 own FTE + 200 temporary workers

Own payroll: 30 × €45,000 = €1,350,000

Temporary workers payroll (estimate): 200 × €28,000 = €5,600,000
